This policy covers our website (phase3permanentweightloss.com), our online forms and quizzes, the WLC 1 Couples Challenge apply form and contest forms, our next-contest list (waitlist), and our emails and text messages.

1. Who we are

We are Gaspar Consulting LLC, doing business as Phase 3: Permanent Weight Loss ("we" or "us").

2. What we collect

When you fill out our forms, you give us:

  • your name, and your partner's name for couples contests
  • your email and cell phone number
  • whether you said yes to texts, and when
  • your county and your answers to the basic yes/no checks (18 or older, live together)
  • your Instagram handle and your story, if you share them
  • your answers to any quiz you take

If you email us for help applying: what you send us.

If you are named a contest finalist:

  • the doctor clearance form: your name, date of birth, phone, email, partner's name, your provider's name, license number, and clinic, "cleared" or "not cleared," any limits, and the visit date and type
  • any health questionnaire we ask you to fill out
  • your signed waiver, photo and video release, and recording consent

If you play in a contest: your height, weight, and waist at weigh-ins, weigh-in videos and photos, your eating window, your daily posts, and attendance.

If you win a cash prize: an IRS Form W-9, which includes your Social Security or tax ID number.

If you buy: what you bought and when. Your card is handled by our payment processor, Stripe. We do not store your full card number.

Automatically: basic device and browser data and the pages you visit, through cookies and similar tools (see section 7).

3. How we use it

  • To run our contests: check who can play, pick finalists and winners, run weigh-ins, and pay prizes.
  • To contact you about a contest you applied for.
  • To email you about our future contests and Phase 3 programs. These emails are ads, and you can unsubscribe at any time.
  • To text you, but only if you checked the texting box.
  • To answer your questions, keep records, and follow the law (for example, taxes).
  • Health and weight information from contest forms is used only for safety and to check that you can play. It is never used for ads or marketing, and it is never sold. We show your weight on camera only if you say OK.

4. Who we share it with

  • We never sell your information.
  • We never share your mobile number or text consent with anyone else for their marketing.
  • We share information only with:
  • companies that help us run our site, forms, emails, texts, calls, payments, and contests (such as HighLevel/LeadConnector, Stripe, Zoom, Skool, Cloudflare, and Google Fonts). They may not use it for their own marketing.
  • the IRS, when tax law requires it.
  • anyone the law requires, or when needed to protect someone's safety.
  • What you post in public (like Instagram or our Skool group) can be seen by others.

5. Text messages

  • Texts are optional. Saying yes is never a condition of buying anything.
  • How often we text varies. Message and data rates may apply.
  • Reply STOP to stop, or HELP for help. We also stop if you reply END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, REVOKE, OPT OUT, or OPTOUT, or tell us in plain words (like "no more texts") by text, email, Instagram, or on a call.
  • We text only between 8 AM and 9 PM your local time.

6. Emails

  • When you apply for a contest, you agree that we may email you about that contest and our future contests and programs.
  • Every marketing email is labeled as an ad and has an unsubscribe link and our mailing address.
  • We honor unsubscribes within 10 business days.
  • If you unsubscribe, we may still send messages you need about a contest you are playing in.

7. Cookies and tracking

  • Our pages use cookies and similar tools from our site host (HighLevel/LeadConnector), Google Fonts, Cloudflare Turnstile (a spam check), and Stripe (payments).
  • These companies may collect data about your activity across different websites over time.
  • We don't use ad tracking pixels (like the Meta pixel) on these pages today. If we add them, we will update this policy first.
  • Do Not Track: we don't currently respond to browser "Do Not Track" signals.

8. How long we keep it

  • Doctor clearance forms and health questionnaires: deleted by June 30, 2027, unless needed for a dispute.
  • Offer and price time stamps, and contest close records: kept at least 4 years.
  • Tax forms: kept as long as tax law requires.
  • Everything else: kept only as long as we need it to run our contests and programs and keep business records, or until you ask us to delete it, unless the law says we must keep it.

9. Security

We take reasonable steps to protect your information. Only people who need to see health forms can see them. No system is 100% safe.

10. Kids

Our contests and programs are for adults 18 and older. We don't knowingly collect information from anyone under 18. If we learn we did, we delete it.

11. Your choices and California rights

  • See or fix your information: email [email protected]. We will answer within 30 days.
  • Delete your information: ask us, and we will delete what the law lets us delete.
  • Stop marketing: unsubscribe from any email, or reply STOP to any text.
  • California "Shine the Light": we don't share personal information with other companies for their own direct marketing (Cal. Civ. Code 1798.83).

12. Changes

If we change this policy, we post the new version here with a new effective date. If the change is big, we also email the people on our list.
